Circle Rates for Properties in Delhi

All the properties whether Residential, Commercial or Agricultural that come under the Union Territory of Delhi, under the limits of Municipal Corporation of Delhi are divided into various categories from Category A to Category H after considering various factors. The Circle rates vary across these categories.Circle rates are the base price of a property below which it cannot be transacted. However there are exceptions to it as well. Where the market price of a property is below the Circle rate in that area, the transaction is done at the market price but the Stamp Duty is payable on the circle rate or the market value of the property whichever is higher. Circle Rate depends on

The Circle rate of properties in Delhi depend on various factors like:

 

(A) Market value of the Locality/ Area

(B)  Facilities available in the area

(C)  Category type of the area for example under-developed area will have lesser Circle rate as it will categorized in lower categories whereas a Posh locality will have a higher circle rate and will be categorized in the top categories.

(D) Property type whether it is Residential or Commercial. For example Commercial Properties have higher Circle value than a Residential Property.

(E)  Also in case of Flats or apartments either built by any Govt body such as DDA or by any private builder, the circle rates vary.

Mostly these factors affect the Circle rate of localities in Delhi. And basis these factors only the Localities are classified into 8 groups, from A to H.So, the areas with the highest values fall under category A whereas the areas with the lowest value fall under category H.

 

How to Calculate the Circle Rate in Delhi?

Circle rate calculation can be understood by below mentioned steps:

1)      Check whether the property is residential or commercial.

2)      Then, kindly check whether it is a builder floor, an apartment/ flat, anindependent house/ bungalow or just a plotetc..

3)      Find the details like age of construction, built-up area of the property (in sqmtrs), plot area (in sqmtrs). In case the area is in Sqft then kindly convert it in SqMtrs.

4)      Find out the locality where the property is situated and take down the Circle rate of that locality and the minimum cost of construction as prescribed by the Govt in that area.

Current Stamp Duty in Delhi

In order to conclude a sale-purchase of a property transaction, the Buyer needs to get it registered in his/her name in the office of the Sub-Registrar after payment of applicable Stamp duty and Registration fee to the Government. The Stamp duty is calculated based on the circle rate applicable or the deal value mentioned in the agreement whichever is higher. The rate of stamp duty in Delhi varies between 4% and 6% depending on whether the property is bought by a male or female or jointly by both.

There is one more factor due to which the circle rates gets impacted in a high-rise housing society. The government has allowed for a floor relief at 2% per floor rise for flats on the 4th floor and above, subject to a maximum floor relief of 20% only of the basic circle rate in that area.

Circle Rates for Properties in Gurugram

The properties are bought or sold at market price, which is generally higher than the circle rates in Gurugram. Circle rate has been fixed by the authorities for every locality and they keep revising it after regular intervals. The stamp duty is payable on the circle rate in cases the market value or the deal price is lower than the circle value. It cannot be paid on the market value as it is less than the circle value. However there is no restriction in case the registration is being done over and above the circle rates. The stamp duty is payable on the market value in such cases.
